Privacy Policy
This Privacy Policy is Effective as of May 28, 2009
For general info:
JJCK, LLC (d/b/a “EmFinders,” also referred to as “we” or “us”) is a technology company. It is our mission to develop and deploy technology that provides cost effective, reliable and rapid location information to law enforcement about the location of a person in distress. Our initial focus in achieving this mission is to provide a service (“Service”) designed to assist caregivers of the most vulnerable members of our society; especially those citizens who become disoriented, wander, and would not be able to use devices such as a cell-phone to alert families or the police to their location.
We value the privacy of our customers, users, and others who use the Service (collectively or individually “Users”). This privacy policy outlines our privacy practices as they pertain to the Service as well as our privacy practices on our corporate Website (“Website”), located at www.EmFinders.com. If you have any questions about this privacy policy, please feel free to contact us at privacy@EmFinders.com.
Privacy Notice for the EmFinders Service
Overview of the Service
Our Service impacts three separate groups: persons with an impairment, caregivers and personnel.
Our Service enables a caregiver to remotely activate 911 emergency location features on a discrete wireless device that is worn or carried by a PWI. So, in the event that a PWI goes missing, the Caregiver is able to initiate our Service, which will, among other things: (a) trigger the device to place an emergency 911 call to local police, (b) enable the police to use the Emergency 911 system to locate the device, and (c) contact the police directly to provide personal information about the PWI as required to assist local emergency personnel in caring for the PWI upon recovery.
Thus, in order for our Service to be effective, we need to collect a good deal of information about the PWI and his caregiver. And if there’s an emergency that requires the caregiver to activate our Service, we’ll need to share that information with emergency personnel.
What information does your Service collect?
Personally Identifiable Information
We collect Personally Identifiable Information (“PII”) in connection with our Service. PII is information that can be used to identify or locate a person or entity, and includes the following:
We may record and monitor conversations between you and our customer service personnel and third parties (e.g. emergency personnel) to maintain or improve the quality the Service, for issue resolution, or for training purposes. Please note that our customer service representatives may remain on the line if they conference in a third party to assist in completing your request, and that we may record and monitor those conversations as well. We will not release any recordings of such conversations unless required by law.
Non-Personally Identifiable Information
We also collect Non-Personally Identifiable Information (“Non-PII”) in connection with our Service. Non-PII is information that cannot by itself be used to identify or locate a particular person or entity and includes certain information collected from the wireless device carried by the PWI such as the IMEI number for the wireless device.
How do we use the information you collect via the Service?
Generally, we use the information we collect to provide you with the EmFinders Service. For example, in the event of an emergency, when a caregiver activates the Service, we will use the information we collect via the Service to notify emergency personnel, and to support their efforts to locate, identify and, if necessary, care for the PWI. We also will use the information we collect to contact the caregiver or a secondary contact person supplied by the caregiver so we may keep them informed regarding the emergency.
We also use information collected from the caregiver to send billing and service announcements via email, regular mail or SMS text-messaging. We give you the opportunity to choose how you’d like to be contacted by us when you register for and activate the Service. Please keep in mind that if you choose to receive SMS text messages from EmFinders, you acknowledge that normal carrier charges and taxes may apply to SMS text messages to and from EmFinders. You may change you preferences by sending a request to us at privacy@EmFinders.com and we will process your requested change within a reasonable period of time after receipt.
We may use information collected via the Service to improve the quality and design of the Service and to create new features, and functionality for the Service. For example, we may compare emergency response times in one local area with response times from another local area.
We may also use information collected from the Service in press releases. For example, we may send out a press release that reads: “Alzheimer’s patient from Philadelphia wanders off and is found thanks to EmFinders.” Please note that we will not use any PII collected via the Service without consent from the PWI caregiver.
Finally, we use information collected from the caregiver to process payment for the Service.

When EmFinders Discloses Information:
We don’t transfer information to third parties for marketing purposes.
As outlined above, we will transfer information to emergency personnel in the event of an emergency when the caregiver activates the Service.
In the event that EmFinders is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditor’s rights generally, we may not be able to control how your personal information is treated, transferred, or used. You will be notified by EmFinders of any such change in ownership or control of your PII.
EmFinders may release any information under our control if required to do so by law, or in the good-faith belief that such action is necessary to comply with state or federal laws or respond to a valid court order, subpoena, or search warrant.
EmFinders reserves the right to disclose any information under our control if we believe, in good faith, that such disclosure is appropriate or necessary to: enforce the Customer Agreement and Privacy Policy; take precautions against liability; protect Users from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of our web site; and to protect the rights, property, or personal safety of EmFinders, our Users, or others.
Your Privacy Choices:

You are responsible for maintaining the secrecy of your unique password and account information at all times.
Our Commitment to Data Security:
The security of your information is important to us, including but not limited to the PII collected via the Service and the Website. We have implemented reasonable security measures to protect the information in our care, both during transmission and once we receive it. This includes, but is not limited to the use of firewalls and encryption. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.
Our Commitment to Children’s Privacy:
Protecting the privacy of children is important. For that reason, EmFinders does not knowingly collect PII from persons under 18 years-of-age. IF YOU ARE A CAREGIVER UNDER 18 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS OUR SERVICE. If EmFinders learns that PII has been collected from a minor via either our Website or Service, then we will take the appropriate steps to delete this information. If you are a parent or guardian and believe that your child under the age of 18 has provided his or her PII to us, please contact us at privacy@emfinders.com.
Please note that in some instances the PWI may be under 18 and their PII may be provided to us from their caregiver so that we may provide them with the Service. Whether or not the PWI is a minor, we won’t use the PWI’s PII except to provide the Service.
International:
The Service is hosted in the United States, and we do not currently offer the Service outside of the U.S. If you are visiting the Website from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring any PII you provide on this Website to the United States and by providing your PII you consent to that transfer.

Privacy Notice for the EmFinders Service
Overview of the Service
Our Service impacts three separate groups: persons with an impairment, caregivers and personnel.
- Persons with an Impairment (“PWI”) – people who have an impairment or another affliction, such as Alzheimer’s, dementia or Down’s Syndrome, that may impact their memory, cause them to wander away, or forget where they are.
- Caregivers – people who care for the PWI. This person is typically a family member of the PWI, a loved one, or a healthcare professional. Sometimes, a PWI may have more than one caregiver. Please note that in the event of an emergency this person or persons may be contacted by law enforcement regarding the physical condition of the PWI, and law enforcement may share with this person sensitive information about the PWI, including their medical status. Please ensure that the caregiver(s) are people who are generally responsible individuals, and persons with whom you are comfortable having this type of information shared.
- Emergency Personnel – people such as law enforcement and 911 professionals who are generally tasked with finding and, if necessary, providing medical assistance to the PWI in the event that he or she becomes lost or disoriented.
- Persons with an Impairment (“PWI”) – We collect their name, address, phone numbers, date of birth, physical characteristics (e.g., height, eye color, gender) and information about the PWI’s medical condition. We also may collect a safe return code # if that PWI participates in the Alzheimer’s Association Safe Return program. Finally, in the event that our Service is activated in order to locate a PWI, we will collect information about the location of the PWI, as well as other information about the emergency, such as the name and location of the hospital the PWI was taken to.
- Caregiver – Their name, address, phone, email, billing information, (e.g., credit card number, payment address) relationship to PWI, and if applicable, the name, address and phone number of the medical institution at which the caregiver works. Please note that the billing information may pertain to the PWI, the PWI’s family member or another interested party. We may also require verification of the caregiver’s authority to represent and bind the PWI, in the event the PWI is mentally incapacitated.
- Emergency Personnel – We collect the name and phone number of the local law enforcement personnel that serve the area where the PWI resides, as well as the name and phone number of the local law enforcement personnel that serve the area where the caregiver resides. Other information regarding local law enforcement and emergency personnel may also be required, depending on the location of the PWI at any given time.
